IMPORTANT MESSAGE
During the 83rd Legislative Session (2025) Senate Bill (SB) 466 transferred the authority to regulate and permit food establishments from the Division of Public and Behavioral Health to the Nevada Department of Agriculture (NDA). The bill was signed by the Governor on June 10, 2025, and became effective on July 1, 2025. A separate bill SB 494 created the Nevada Health Authority (NHA). These bills reorganized the Environmental Health Section into two separate programs. The NDA is responsible for all the food programs regulated in NRS and NAC 446, 583, 585 and 445A. The NHA will provide support for all non-food programs regulated under NRS/NAC 444, 585 and 447.

General Information
The Nevada Division of Public and Behavioral Health inspects Public Accommodations (i.e., Hotel/Motels) on a complaint basis. Inspections are to determine if the facility is in compliance with health and safety laws of the State of Nevada, and to initiate enforcement procedures when necessary.
The Nevada Division of Public and Behavioral Health permits and inspects multiple program types within a Public Accommodation (Hotel or Motel) including Public Bathing Places (Pools and Spas) and Food Establishments in accordance with Nevada State Law. Public Accommodation Plan Reviews
Any person who desires to construct a hotel or to remodel or add to an existing hotel must apply in writing to the health authority. The application must be accompanied by plans, specifications and supporting information. Plans and specifications for a public accommodation must be prepared by a professional engineer and architect who is registered in the State of Nevada and a licensed contractor who hold a license issued by the State Contractors' Board in the appropriate classification.
